CleanSafe Terms and Conditions

General

  • CleanSafe shall carry out the Services or Works as Specified.
  • The client shall provide access for CleanSafe surveyors and technicians to carry out its services at any reasonable time.
  • The client shall provide hot water, electricity and lighting in adequate supply such that the Service may be carried out to the standard agreed.
  • CleanSafe reserve the right to charge, by the hour, for any wasted journeys due to failure to observe appointments, delays in carrying out the work or cancellations as a result of the Clients failure to allow access, or provide proper instruction.
  • CleanSafe reserve the rights to use photographic images taken during the course of works for marketing and/or report production purposes. These images are the property of the company and may not be reproduced, copied or taken for any other purpose without permission.
  • If, prior to works commencing, the client does not wish any photographic images to be taken then this must be stated in writing to CleanSafe.

Liability

Nothing in this agreement affects the statutory rights of the consumer. Subject hereto all representations, warranties, guarantees and conditions express or implied, statutory or otherwise are expressly excluded and CleanSafe does not accept liability for loss, damage, or injury howsoever arising save as specified in this clause below:

  • Personal injury or death which is a direct result of CleanSafe’s negligence in the course of carrying out the Services.
  • Replacement or (at CleanSafe’s option) repair of any equipment or components comprised therein which are defective or unsuitable for purpose due to faulty workmanship, design or materials.
  • The client shall not be entitled to make any claim against CleanSafe or its employees unless it gives written notice of the event giving rise to such claim, containing sufficient information for it to be investigated by CleanSafe within 28 days of the date on which the client becomes or ought reasonably to have become aware of the occurrence of such event.
  • CleanSafe shall in no circumstances have any liability for any loss of profit, use or business interruption or other indirect, economic or consequential loss or damage.

Builder Cleans

  • All work is priced at time of survey. If upon instruction and commencement of work it is found that the plots/units are in a much dirtier or worse condition that at time of pricing we reserve the right to amend our price accordingly or issue a variation invoice.
  • Where we have to use scrapers to clean windows we will first wash the window and inspect the glass for damage before using a window scraper. All damage will be reported to the site manager and highlighted on our report. We do therefore not accept any claims for damages to glasswork on-site.
  • Once a plot/unit has been cleaned and signed off any further cleaning (unless previously agreed in writing), will be charged for.
  • If the project is over-running and where we are unable to carry out our work through no fault of our own, we will apply an appropriate charge for this time.
  • Where projects over-run through no fault of our own we will pass any charges for additional plant/access or machinery hire onto the client.

Force Majeure

  • If circumstances reasonably beyond CleanSafe’s control cause delay or prevent the Service being carried out in accordance with the survey then CleanSafe shall be excused the performance or the punctual performance of the Services, which may then have to be rescheduled for a future date.

Invoicing Arrangement

  • (A) The Company reserves the right to make deliveries/and or services by instalments and to render a separate invoice in respect of each such instalment.
  • (B) If the Company exercises its right to make deliveries/and or services in accordance with sub-paragraph (A) above, then any delay in the provision of such deliveries/and or services, or failure to deliver any further instalment or instalments, shall not entitle the Buyer to reject the Contract or the delivery/service of any other instalment or to withhold payment in respect of any instalment previously delivered/serviced.

Payments

  • CleanSafe operates a strict 30-day payment term, which begins after the completion of the first Service.

Health and Safety

  • The client shall take all reasonable precautions necessary to protect the health and safety of persons using the equipment and the premises.

Variations

  • No variation, extension, exclusion or cancellation of this Agreement will be binding unless an authorised manager of CleanSafe confirms it in writing.

Severance

  • If any term or provision in this Agreement is or shall become in whole or in part, illegal, invalid or unenforceable, the legality, validity and enforceability of the remainder of the Agreement shall not be affected or impaired.

Set Off

  • The Client shall not be entitled to withhold payments of monies due under this Agreement by reason of any claim or counterclaim it may have or alleges to have against CleanSafe or otherwise which is not related to the Service.

Notice Period

  • All CleanSafe Services customers are required to give notice of 30 days or more in writing prior to termination of a contract.

Entire Agreement

  • This Agreement constitutes the entire agreement between the Client and CleanSafe.
  • The Client shall not be entitled to rely or to seek to rely upon any statement, warranty or representation made by or on behalf of CleanSafe to the extent that such representation is inconsistent with these terms and conditions.
  • All work for the Service will be subject to these Terms and Conditions which shall prevail over any inconsistent terms which may appear on the Client’s enquiry, order or other documents received by CleanSafe from the Client or which may be implied by law or trade, custom, practice or a course of dealing between the parties, all of which are hereby expressly excluded. All Orders are accepted and executed on the understanding that the Client is bound by these conditions.
